Occupational Mould and Mycotoxin Exposure

In January 2023, Queensland police officer Senior Constable Justin Darney passed away at just 38 years old from a rare and aggressive form of pancreatic cancer.
His illness was linked to prolonged exposure to toxic mould and mycotoxins at Logan Central Police Station, where visible mould contamination had been present for more than a decade.

This tragic case is now recognised as the first recorded Queensland workplace death arising from mycotoxin mould exposure, and has raised urgent questions about the need for stronger workplace mould assessment, remediation & regulation.

What happened?

From 2009 to 2020, mould was visibly present throughout the police station: on walls, ceilings, furniture, hallways, and even in kitchen areas. Despite repeated concerns raised by staff, the mould was painted over rather than properly remediated, allowing the contamination to persist and spread.

Constable Darney himself reported the mould problem as early as 2013, recalling that it regularly transferred to his clothing while at work. However, no long-term remediation or relocation of staff occurred.

Health Impacts and Diagnosis

After more than a decade of daily exposure, Justin began experiencing serious health symptoms, including:

  • Chronic fatigue

  • Respiratory irritation

  • Visible jaundice (yellowing of skin and eyes)

In May 2020, he was diagnosed with poorly differentiated neuroendocrine carcinoma (large cell type) with liver and spleen metastasis. This rare pancreatic cancer was later linked to his workplace exposure to mould, particularly Cladosporium species, and associated mycotoxins.

Medical specialists confirmed that mycotoxicosis, caused by the accumulation of fungal metabolites in the body, had likely contributed to chronic inflammation, a known risk factor for cancer development. Laboratory testing in 2021 revealed elevated IgG antibodies to multiple mycotoxins, further supporting the connection.

Environmental assessments and testimonies highlighted:

  • Visible mould growth across multiple areas of the building

  • Prolonged high levels of exposure for staff without adequate remediation

  • Failure to provide a safe alternative workplace, despite repeated warnings

This case demonstrates how long-term occupational mould exposure can escalate into severe, life-threatening health consequences.

Legal and Regulatory Response

Justin’s widow, Shari Freer-Darney, supported by Slater and Gordon Lawyers, has called for:

  • A Coronial Inquest into his death to hold Queensland Police Service accountable.

  • Stronger national workplace legislation around mould and mycotoxin identification, remediation, and reporting.

  • Recognition of Justin’s death as an on-duty workplace fatality, ensuring his service is commemorated and his children receive his medals of honour.

 

Legal representatives have emphasised that this may be the first occupational death caused by mould and mycotoxin exposure, highlighting the urgent need for reform.​​
